1) Music on websites annoys people immensely. Avoid where possible. It's like people who put big spoilers on little cars. They think it looks cool but it doesn't. Just because you can, doesn't mean you should.
2) Couldn't hurt to contact the person who holds the rights, unless you're talking about proper commercial music, in which case they'll obviously say no but will never enforce it in reality so you may as well go ahead.
3) Did I mention how annoying music is when crowbarred into a website? It really is. The only sites where it's acceptable are musician's sites, and other sites where the whole point is the music.
