legal advice req

The company who have put in my new bathroom and have made a complete cockup of it and i have now been chasing them for over 3 months to come back and finish it have now advised me that they have ceased trading and have gone into liquidation, I have not paid them any money although more materials are going to have to repurchased to finish the job off properly. All the materials were provided by me and all the company did was to surpply the labour.
How do i stand i am obviously going to have to get someone in to complete it but how do i stand as i have not paid them anything and have stated that they would be paid when the job was completed to my satisfaction
I have asked for the name of the liquidator but as yet have heard nothing nor is anything reg at company house although a message has been left on the phone saying that the company has ceased trading.

As they have gone into liquidation they can not nor should not do anything. The liquidator arranges everything. Personally I would not go chasing them to pay them money, I would wait until the liquidator contacts me as a debtor to the company. It's up to the company to provide the liquidator with a list of the assets, debtors and creditors and the liquidator will then post notices and make contact. You have no obligation to do anything, at the moment.

Did you sign a contract? No signed contract, no problem. You provided materials, no problem. It is unlikely you will hear anything.

As stepheno says, the liquidator will now handle everything involved in winding up the company, and any contact or correspondence will come from him.

Since they have made a mess of the work and you now have to incur additional costs in repurchasing materials, my advice would be (a) that you owe them absolutely nothing, and (b) that it may even be worth submitting a claim to the liquidator for reimbursement of the additional monies you have had to spend. Unfortunately it is unlikely you will get anything, but it does depend on what assets the company has.

You did absolutely right in refusing to pay them until the work was completed satisfactorily. Many people are not so prudent, and pay up-front to companies or individuals who subsequently disappear. The building industry is full of cowboys and fly-by-night merchants, especially at the moment in areas which were affected by flooding earlier this year.

Be suspicious of anyone who wants you to pay in advance (and don't do it!), or if they ask you to buy materials. Reputable contractors and tradesmen have accounts with merchants and suppliers - if they don't, it is probably because they can't get credit.

Heard of one job someone did put in a toilet and wash basin into a small cloakroom 2 moths later bad smell, builder vanished, new builder came lifted up toilet.............Not even connected to a sewer just a big hole dug out under it!!!!!!!!!!!!!!!!!!
