legal advice req (again)
If a false claim is made about a company going into liquidation to get out of problems etc and is then found to be continuing under another name.
Is there any comeback etc . Basically the builder i employed who couldnt build with lego has been given 14 days notice to recify the problems with the work he has carried out yet on the 14th day i recieved notification that the company has ceased trading and has gone into liquidation although they have so far refused to let me know the name of the appointed liquidator. Trading standards are also involved and no record to date had been found of the said company going into liquidation, I as do trading standards he is taking the perverbial ![]() Thankfully i havent paid him any money ayt all so far although i supplied all the materials now its looking after the first estimate that it will mean i have to repurchase many items etc again. Small claims court here i come however if he has gone into liquidation which i doubt for one minuite and has signed the house etc over to the cat whats my chances. The company was not limited so in my eye as a sole trader even under another name they are still liable. |

Re: legal advice req (again)
Perhaps a solicitor or CAB is the place to ask about this?

Re: legal advice req (again)
i think the first thing you have to do is find out wither they have just " ceased trading" or actually have gone into liquidation which are two different things, if they have ceased trading you can then go to petition the courts to have them placed on compulsory liquidation.
have a read here its pretty interesting........ FAQs - Frequently Asked Questions |

Re: legal advice req (again)
try Community Legal Advice or have a look at any insurance policies you have for any legal advice added to the policy. My car insurance policy with tesco has 24 hour legal advice which covers any legal advice on any private legal matter, most people think these advice lines only cover motoring!!! Also if you work for a large firm might be worth checking they dont offer something like this, i know my work offers it which isn't that well known in our company.
The CAB can be a nightmare to speak to on the phone, recently tried getting advice for a polish guy at work and spent hours trying to get through to them in my area. So might be easier to go in to your local center. Anyway good luck
