Whoops.....

Hi

I was taking an image of helicopter in the sky today and someone got upset about being in the shot. This guy was 200 yards away (some distance anyway), and getting into his car.

He drove over to me and said he hoped I wasn't taking pictures of his car. I showed him what I'd taken and seemed satisfied.

The car park belongs to the local county council; I would have said it was a public area.(No kids around)

My question is can he sue me? (this was not far from my house me but i'd never seen him before)

I've have deleted all images concerned completely.

If you were in a council car park there could be restrictions on taking pictures, but you would have to check what their policy is. You might find that a car park for the council offices has different rules than a car park at a park.

If there was CCTV in operation the guy would have been on camera anyway.

No, village hall car park.

It's more than likely he'd just come from the village shop. There is a camera situated outside the front of the premises, true enough. Whether it's running/dummy or not is another matter. Good point though.

I've checked under the V.H. web site and nothing is stated one ay or the other, no terms or conditions as such.

YOu don't know now, I ve no real desire to be facing a court summons at the moment. His approach was a little aggressive and I wonder what his options are if that's how he feels.

Personally, I would not have shown the photographs I had taken as he has no right to see them or demand to see them. I would in fact have taken a clear picture of his car number plate and reported the incident to the police as he was clearly acting suspiciously.

This is where I wanted to get to, where I stood. My understanding was it was a public place, as an acquaintance has observed, no real different to say the Tower of London where cameras (I dare say) are a matter of course.

Unfortunately I'm not in a good place for one reason or another and thus was probably on the defensive.

Taken by surprise, I got the feeling the guy had a bit of an axe to grind (young chap 25 ish) and gut feeling told me to rid myself of this character ASAP.

I understand. I would also have tried to avoid winding him up but would not have allowed him to look at my camera as he has no right so would have called the police if he pressed. There are only a very small number of places in the UK where photography is not allowed and would be a criminal offence. There are clear notices at such places and most are clearly government or military establishments. Anywhere else it is perfectly legal to take photographs. What you do with the photographs is where you might come across restrictions but these are all civil matters not criminal.

So if you take a photograph of someone and say used photoshop to make it appear that they were emerging from a brothel then showed the picture in public without their permission, the individual could then sue you for defamation. Just a shot of someone in a public place would not be defamation and if they were indistinct in a wider scene there is no problem anyway. You can often take photographs on private property on condition that you do not commercially exploit them without permission (which would normally mean sharing royalties). I only use my photographs for non-commercial reasons so I am not at all worried about possible restrictions.

I had a recent experience and was collared by the local plod after I was doing some street photography in town. someone had phoned the police im sure I knew who it was after althou I didn't know them personally . The plod in question said they had a report that I'd been taking pictures of children which I hadn't and I showed him the images on my DSLR he was quite happy with that althou he asked for ID which I gave althou I wasn't doing anything wrong and then proceeded to ask him the laws on begging which he asked why and I said that as I undestand is more of a illegal activity wouldn't the time he'd wasted on me be better took up sorting out the people sat in doorways asking for money etc . He got quite upset and started "throwing his weight about" Thing is many people use phones now to take images and if people think that if I was up to no good would I really make it that obvious walking round with a DSLR . if I'd of been at the local or any swimming pool and taking images I wouldn't anyway but could have understood it. I thought after what would he have done if I had images of my grandchildren on the camera etc . Same in local shopping centres etc and as Dave knows in a area that's called The Brewery

You remember the visit to the Brewery. The only thing is that, by the time that security guard appeared, we had taken all the shots we wanted. However, it was private property so they were entitled to ask us to stop which we did.

There was incident just a few yards away about year ago.

I THINK it was a young woman taking images earlish one morning and a guy in a transit tipper took exception.........BIG exception. It got very loud and very nasty ........ the guy wasn't sparing the f's and c's etc etc and I didn't want it to got there (I might be completely wrong. I didn't go too near).

I do sense there is some sensitivity now as, a someone said every one is out with an ipad or whatever.

Thanks the support, confrontation is what I don't need just now and need to be more circumspect for my own policy in future.
