Charging Elephant - as promised.... (B&W)
I'd love to be able to say I took this, but I didn't..... I found the pic on the front of a local magazine here in RSA. I'm told the guy who took the image has now passed on....... but doesn't it have a terrific drama about it.......and what could be done to improve it?
FWIW, my guess is that it's a Botswana Elephant..... if not Botswana exactly, it's certainly Southern Africa somwehere...... ![]() Last edited by shakari : 13-01-2006 at 08:41. |

I just realised this thread is in 'photo sharing' not the General forum, and as nice as the picture is, I'm quite sure there are Copyright laws which prevent you from scanning magazine covers and posting them on the internet. Its surely a lawsuit waiting to happen and it *might* be better to remove it? (Unless you have permission from the copyright holder?)
As for modifying it - I'm not touching this one with a very long cloning stick. |

I discussed this on a previous thread yeasterday and asked if I could/should post it and was told it's OK......... having said that, I'm more than happy to remove it if the forum moderator would prefer me to do so.
As I understand it from the editor of the magazine that published it, the guy who took it is now dead and therefore I was able to use it...... In other words I contacted the editor as I wanted the image for something and was willing to pay for it's use...... he told me to go ahead at no charge as the image no longer has an owner. (In the end, I didn't use it as I managed to take something myself that I preferred. As I said, I'm happy to remove it if necessary and apologise for any embarrassment caused....... 'Fraid I have no idea of lens etc used. I'll give it an hour or two and if I haven't been told it's OK to leave it on the post, I'll remove it. |

Well I'm no lawyer but I'm almost certain that Copyright remains with the copyright holder until 75 years AFTER their death. So I guess if he died before 1931 it'd be ok. Without all the facts its a grey area....

Yes it does remain with him until 75 yrs after he died. However, if he owned the copyright and it wasn't passed on as part of his estate, then who is likely to argue? Or collect royalties, for that matter.
If he was an employee of the magazine, odds are the copyright remains with them anyway, and as they have given permission for the image to be used... I would suggest that he does deserve a mention by name though. |

'Fraid I don't know the name of the photographer but the magazine is "The Big Bore Rifle Association"..... based in RSA.
It's now 1900 hrs CAT. I'll wait until 2000 hrs and if I haven't been told (by a moderator) it's OK to leave the image posted, I'll remove it. Love the spanish bull by the way! |

Copyright only extends in these sort of cases if the poster is trying to make money off it. As long as accreditation is given then there are no problems.
We deal with this stuff all the time at work - images taken by people 'no longer around' so to speak. Shakiri asked and I said post it, but make it clear the image doesn't belong to him. If it's been published, then it's already in the Public Domain. Credit the Publication you got it from aslo. Last edited by Arkady : 13-01-2006 at 07:58. |

That's one Hell of a shot!
![]() I wouldn't touch it personally - the slightly low contrast and less than optimum sharpness all convey the feeling of movement and dust being thrown up. It's a great original shot and it would be very easy to spoil it. It looks like this was scanned from a print with a textured surface - you can see the texture in the ears. If you have to scan from prints, always get your prints done on plain glossy or matte paper - textured prints never scan well, although for optimum quality from film you should really be looking at getting a decent negative scanner unless you're going digital any time soon. Having said that, even if you go digital and have a large archive of negatives, the negative scanner would probably still be worthwhile.

Think I'm going to get myself a Canon 350d Rebel and also upgrade to a really good scanner for the images I already have.
I was suprised at the price difference on this camera...... in the US I can buy one for about US$650, in the UK it's about US$750+ and here in RSA it's about US$1250. I'll carry on with the price checks and then wait till I have a client coming over from the right country and ask him/her to bring one with them. There's a guy in Botswana by the name of Randall Moore who owns "Abu's Camp" in the Okavango Delta. It's a very high dollar photo safari lodge and the tourist transport is all on Elephant back...... The camp is named after an Elephant named Abu who also starred in a lot of movies including White Hunter Black Heart. Abu's dead now but I'm told if he saw a camera pointing his way, he'd give it a full out charge and skid to a stop a couple of feet from the photographer and then saunter off......... Randall wrote a book called Elephants For Africa and it has some of the very best photography I've ever seen in it. The book costs a bloody fortune but the images make it worth every penny....... I'm lucky enough to have a wife who likes to buy me signed first editions, so I'm lucky enough to have a great copy of this book...... Bearing in mind what's been said here about copyright, would anyone out there like me to scan a few images from the book and post them on the general photography & chat forum? - obviously with the relevant mentions...... Well most of us have bit the bullet and changed over to digital. It's an expensive business as it usually means getting new lenses which is the real outlay of course, but it can be done gradually.
